You do not have to provide Personal Information to AppCard, but you may not be able to take advantage of some or all the features of the Service if you do not. You acknowledge that this information may be personal to you, and by creating an account on the Service and providing Personal Information to us and or the Merchant, you allow us (and others to the extent permitted under this Privacy Policy) to use your Personal Information in the manner set forth under this Privacy Policy. We may use your contact information to send you information about our Service. Tracking Information and other Non-Personally Identifiable Information: AppCard, Merchants and our third party service providers may use tracking technologies, such as cookies, web beacons, pixel tags and clear GIFs (and similar technologies that work on the Smartphone App), to collect data related to usage of the Service, the Programs, and web and email marketing conducted by or on behalf of AppCard. Such data may include, without limitation, the latitude and longitude (i.e., lat/long) coordinates of your device, the region where your device is located, geo-IP data, the address of the websites you visited before and after you visited the Service, the type of browser you are using, your Internet Protocol (IP) address, what pages in the Service you visit and what links you clicked on (collectively, “Tracking Information”). We may use the Tracking Information and other Non-Personally Identifiable Information (as defined below)for the purposes described in this Privacy Policy, such as to serve targeted advertising content to you. We do not knowingly use tracking technologies to automatically retrieve Personal Information from you without your knowledge. However, some Tracking Information may include data, such as IP address data or the identifiers associated with your device that are unique to your computer or device(e.g., IDFA for iOS and Android ID for Android). You may be able to modify your browser or device settings to alter which tracking technologies are permitted when you use the Service, but this may affect the performance of the Service. Interest-Based Advertising: We may ourselves, or with third party vendors, use information we collect in connection with Merchant, or vendor information to deliver targeted advertising to you across websites and mobile applications. To be clear, de-identified information may include hashed email addresses or other unique identifiers that no longer personally identify you. As a result, we and our vendor know your interests, but do not personally identify you in connection with the delivery of that specific ad. We believe that such advertising is helpful because you will see advertisements that are relevant to your interests. However, if you would like to opt-out of these interest-based advertisements, please follow the opt-out process described below under “Opt-Out.”

Contest and Sweepstakes: We may, from time to time, offer surveys, contests, sweepstakes, or other promotions through our Website, Merchant websites, or through our other forms of communications with you (collectively, the “Promotions”). Also, in the event that you prevent the sharing of location information, we may still estimate your general location based on the IP address you use to access our Services.

Interest Based Advertising. The online advertising industry also provides websites from which you may opt out of receiving targeted ads/interest-based advertising from us and our data partners and our other advertising partners that participate in self-regulatory programs. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

3. Debug products to identify and repair errors that impair existing intended functionality.

4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).

6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.

7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

Comply with a legal obligation.

Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

When exercising this right, please identify the information that you wish to be deleted and whether you would like to delete your account from all AppCard account retailers or just a particular retailer. Please note that the exercising of your right to deletion will result in the deletion of the personal information that we have collected about you. This may result in our inability to further provide services to you in the future.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

Mail AppCard Inc. 90 John St. Suite 602, New York, NY 10038
email us: ccpa@appcard.com
Visiting www.appcard.com

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

• Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.

• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.  Making a verifiable consumer request does not require you to create an account with us.  We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within 45 days of its receipt.  If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.  If you have an account with us, we will deliver our written response to that account.  If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.  Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt.  The response we provide will also explain the reasons we cannot comply with a request, if applicable.  For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.  If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

• Deny you goods or services.

• Provide you a different level or quality of goods or services.

• Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
